Terms of Service

These terms govern the services Omni Hosting provides through omnihosting.co.in — website design and development, eCommerce, digital marketing, CCTV supply and installation, Tally supply and support, and related IT work. Hosting, domains and SSL are sold separately on omnihosting.in under the terms published there.

By accepting a quotation or paying an advance, you agree to these terms.

Scope of work

Every engagement begins with a written quotation that states what is included, what it costs and roughly how long it will take. That quotation, together with these terms, is the agreement between us.

Anything not listed in the quotation is outside the scope. We will tell you before doing such work and quote it separately. We do not add to an invoice without telling you first.

Your responsibilities

Projects depend on material only you can provide. To keep to the agreed timeline you will need to supply, in reasonable time:

  • Content, photographs, logos and any brand material
  • Access to existing hosting, domains, analytics or advertising accounts where relevant
  • Feedback and approvals at the checkpoints stated in the quotation
  • For CCTV work, access to the premises and a working power supply at each camera position

You confirm that any content you give us is yours to use, or that you hold the necessary licence for it. We are not responsible for a claim arising from material you supplied.

Timelines

Timelines in a quotation assume your material and approvals arrive when agreed. Delays in receiving them move the delivery date by at least the length of the delay.

Some steps depend on third parties we do not control — payment gateway KYC approval, domain transfers, and hardware availability among them. We will keep you informed, but we cannot guarantee a third party’s turnaround.

Revisions

Each quotation states how many rounds of revisions are included. A revision is a change to work already delivered within the agreed scope. A change of direction, a new requirement or a redesign after approval is new work and is quoted separately.

Payment

Unless the quotation says otherwise, projects are billed as an advance before work begins and the balance before delivery or launch. Recurring services such as SEO, advertising management and maintenance are billed monthly in advance.

All prices are exclusive of GST unless stated. GST is charged at the applicable rate and shown separately on every invoice.

Advertising spend on Google or Meta is paid by you directly to the platform from your own account. It is not part of our fee and we do not mark it up.

Invoices are payable within the period stated on them. We may pause work on an account with an overdue invoice, after telling you.

Ownership and handover

On full payment, you own the website, its design, its content, your domain and all associated accounts. We hand over every login in writing at project completion.

We retain ownership of our internal tools, code libraries and working methods, and we may reuse general techniques and components on other projects. We do not reuse your content, branding or data.

Third-party software used in a project — WordPress themes, plugins, gateway SDKs — remains licensed under its own terms.

Portfolio

We may show completed work in our portfolio and marketing, including a screenshot and your business name, unless you tell us in writing that you would rather we did not. We will never publish figures or internal information you have asked us to keep confidential.

Confidentiality

We keep what we learn about your business confidential, and we will sign an NDA on request. This applies equally to white label and outsourced work, where we will not contact your clients at any point.

Support after delivery

Website projects include a support period stated in the quotation, covering fixes to work we delivered. It does not cover new features, content changes, third-party breakages or problems caused by changes made by someone else.

After that period, support is available on an annual maintenance contract or as a quoted job.

Warranty and limitation of liability

We carry out our work with reasonable skill and care. Hardware we supply carries its manufacturer’s warranty, which we help you claim.

We do not warrant that a website will be free of every defect, that search rankings will reach a particular position, or that advertising will produce a particular result. Search engines and advertising platforms are outside our control and nobody can honestly promise a ranking.

To the extent permitted by law, our total liability arising out of an engagement is limited to the fees you have paid us for that engagement. We are not liable for indirect or consequential loss, including lost profits, lost data or business interruption.

Nothing in these terms limits liability that cannot lawfully be limited.

Ending an engagement

Either of us may end a monthly service with thirty days’ written notice. Work already delivered and the current month remain payable.

For fixed-price projects, if you cancel after work has begun, the advance is retained and any work completed beyond it is invoiced at the proportion delivered.

Changes to these terms

We may update these terms. The version that applies to your engagement is the one in force when your quotation was accepted. Material changes affecting ongoing services will be notified by email.

Governing law

These terms are governed by the laws of India. Courts at Patna, Bihar have exclusive jurisdiction over any dispute, subject to the resolution steps below.

Before starting proceedings, both of us agree to raise the issue in writing and try to resolve it in good faith. Most disagreements end with a phone call.
